I use two trial approaches to win your case. The Trial by Declaration avoids a court appearance and costs less. The Court trial where I personally appear with subpoena and written law motions and my expertise costs more and much more certain of victory.
The Court Trial Vs a Trial by Declaration
A court trial has the greatest opportunity for a dismissal. This is so because as a traffic trial lawyer there are many things I can do that I cannot do with a Trial by Declaration.
First, I am present in court with all the flexibility and years of experience in getting good results. I always file a subpoena duces tecum to get necessary trial evidence from the other side for cross
examination and to show the failure of the other side to produce necessary evidence. I cannot file a subpoena in a Trial by Declaration.
Another big difference is that I can and do confront the judge with law that will cause the judge to dismiss the case and that cant happen very well in a Trial by Declaration.
Further, I can really go after the police officers failure to produce the necessary evidence and to object to his evidence and testimony. I cannot do that nearly as effectively with a Trial by Declaration.
In other words, the best way to get a dismissal is to fight your traffic ticket case in court, taking on the judge and cop with law defenses that make it very difficult for the cop to win.
On the other hand, the price difference is significant and so a Trial by Declaration then becomes a possibility defense that creates several chances to win the case without going to court and for a much lower legal fee.
The Trial by Declaration can be won because the officer fails to file a response, if the judge rules in favor of the law defenses I use and if the officer fails to show up at the court trial. These are very good reasons to fight your traffic ticket with a Trial by Declaration. Especially because the cost is minimal and you cannot lose your right to a court trial.
If you can, fight your traffic ticket case with a court trial. If not, fight it with a Trial by written Declaration.
My policy is to reduce my trial fee by the amount paid for the Trial by Written Declaration. My fee for a Trial by Declaration is $400-650. My trial fee for a local trial is $1800. So if the case were first fought by a 400 dollar Trial by Declaration and a court trial was necessary, my trial fee would be $1400. There is a postage cost and cost of service of process for the ubpoena, or about $70 in court costs.
Traffic Tickets should always be fought. The cost of a DMV point is about $1800 over the three year period of increased premium costs.
I have excellent trial results of about 95% in court speeding cases.
I represent lots of truckers with Trial by Declarations that not only have law defenses but I also also ask for a no DMV point conviction to avoid the point and one half that truckers are socked with. Truckers cannot go to traffic school, believe it or not. Many judges are aware of this unfairness and so will often allow a trucker to plead guilty to a non point conviction.
