The Trial By Declaration (TBD) is a simple way to fight your case without going to court. The TBD case can result in a case dismissal in a number of ways.
Here are some of the ways a well drafted TBD and/or Court trial can result in case dismissal:
1. The Judge dismisses the case on the law.
2. The judge has a "reasonable doubt about guilt, case dismissed.
3. The officer fails to file the "Officer’s Declaration, case dismissed.
4. The Officer declares he has no recollection of the case, case dismissed.
5. At the Trial De Novo (court trial if TBD failed), if the police officer does not show up, case dismissed.
6. If the officer is ready to testify, ask for traffic school, case dismissed.
Even if you lose the Trial By Declaration TBD, you still have the right a new trial in court!
When a citizen represents themselves, for the officer’s its like "shooting fish in a barrel." It’s painful to watch a nervous citizen trying to defend themselves with "principal" rather than law. Go to Court and watch for yourself. The judge knows that most of the officer’s testimony and documents are inadmissible hearsay, but can’t help you out.
